Terms and Conditions
Please read these terms and conditions before booking, as they form the basis of the contract between you and Dalherrick Farm Retreat.
In these terms and conditions “we”, “our” and “us” means Dalherrick Farm Retreat, and “you” and “your” means all guests named on the booking. The person who makes the booking (the “lead guest”) accepts these terms on behalf of everyone named on it. “Written” or “in writing” includes email.
No contract exists until we confirm in writing that your deposit has been received. If we are unable to accept your booking, any deposit you have paid will be refunded in full.
We do our best to make sure the information and prices on our website are accurate. Occasionally changes or errors occur, and we reserve the right to correct them. Please check the current price and details with us before booking. All retreats are subject to availability.
Enquiries and Booking
We like to speak to everyone before they book, so that we can be sure the retreat is right for you. Please get in touch through the enquiry form on our website or by email at info@dalherrickfarmretreat.co.uk.
Once your retreat dates are agreed, we will send you an invoice to be paid online. A non-refundable deposit of 20% of the total retreat price is required to secure your booking, and your booking is not confirmed until the deposit has been paid.
The balance is due no later than 6 weeks before the start of your retreat. If it is not received by this date, we reserve the right to cancel your booking and retain the deposit.
If you book within 6 weeks of the start of your retreat, full payment is required at the time of booking.
We reserve the right to refuse any booking request, at our discretion and for any lawful reason, and we are not obliged to provide an explanation for any such refusal.
Prices and What’s Included
The retreat price includes four nights’ accommodation, the full three-day programme, all guided meditations, one complementary therapy treatment per guest, T’ai Chi, sound bath, excursions and transport during the retreat, and refreshments in the retreat room.
The following are not included unless agreed in writing: single occupancy supplement, additional therapy treatments, pre-ordered meals, airport and station pick-ups, extra nights, and any admission fees or purchases you choose to make when we are out and about.
Changes by Us
We will do everything we reasonably can to run the retreat as described. However, we may need to adjust the programme, for example because of weather, road conditions, or the availability of one of our practitioners. Most changes will be minor, such as swapping the order of activities, and we will let you know as early as we can.
If we have to make a significant change to your retreat, we will tell you as soon as possible and you will be entitled to:
i. accept an alternative date or activity of equivalent quality, if we are able to offer one, or
ii. cancel your booking and receive a full refund of all monies paid.
Changes by You
If you would like to change any part of your confirmed booking, please let us know in writing as soon as possible. The lead guest should make the request. We will do our best to help, but we cannot guarantee that a change will be possible, and you may need to cover any extra costs involved. If we cannot make the change and you no longer wish to come on the original dates, this will be treated as a cancellation by you.
If you are unable to come, you may transfer your booking to someone else, provided that we are told in writing at least seven days before your retreat starts, and the new guest agrees to these terms.
Cancellation by Us
We will only cancel a retreat because of unavoidable and extraordinary circumstances outwith our control, or where going ahead might put your safety at risk. If we cancel, we will tell you as soon as possible and refund everything you have paid in full.
Cancellation by You
If you need to cancel, please let us know in writing as soon as possible. Refunds are as follows:
More than 6 weeks before your retreat: full refund minus the deposit
Less than 6 weeks: no refund unless we are able to fill your cancelled booking with a replacement booking (subject to any deductions taking into account any discounted price we may be required to charge in order to secure the booking at a later stage).
Any pre-ordered meals or third-party costs already paid on your behalf may not be refundable.
Arrival and Departure
Arrival is from 3pm on the Monday of your retreat, and departure is by 10.30am on the Friday. If we are collecting you, please make sure you are at the agreed pick-up point at the agreed time. We cannot accept responsibility for missed pick-ups or any costs arising from them, and no refunds can be given for any part of the retreat you do not use.
Accommodation and Occupancy
The retreat is for one or two guests. Sleeping arrangements are one double bed and a double sofa bed in the sitting room, with access to the bathroom through the bedroom, so please make sure these suit your party before booking. The number of guests staying must not exceed the number on your booking.
Health and Suitability
The retreat is gentle and unrushed, but it does include short walks on uneven ground, T’ai Chi, a sound bath, complementary therapies and use of a hot tub. It is your responsibility to make sure that you and everyone in your party are well enough to take part.
If you have any medical condition, disability, injury, or are pregnant, please tell us when you first get in touch so we can talk through whether the retreat and each activity is suitable for you. If we are not told, we cannot be responsible for any cost or inconvenience if we are unable to accommodate you.
The retreat and its activities are not a substitute for medical or psychological treatment. You are free to sit out any activity at any time.
If, acting reasonably, we are unable to meet your needs, we will not confirm your booking or, if we were not told at the time of booking, we may cancel your booking and the usual cancellation charges will apply.
Complementary Therapies and Practitioners
Treatments, T’ai Chi and a sound bath are provided by independent local practitioners, who work under their own terms, qualifications and insurance. Your practitioner may ask you to complete a short consultation form before your session and may decline or adapt a treatment if they feel it is not suitable for you.
Excursions and Walks
Excursions involve travelling by car and walking on tracks, lanes, grass and uneven ground in all weathers. Please bring suitable footwear and waterproofs. We will always put your safety first and may change or shorten an excursion if conditions require.
Hot Tub, Grounds and Wildlife Pond
You are welcome to use the hot tub, guest garden, summerhouse and grounds during your stay. Please use them with care and follow any guidance provided. The hot tub should not be used after drinking alcohol, and you should check with your doctor before using it if you are pregnant or have a heart condition, high or low blood pressure, or any other health concern. The grounds include a wildlife pond with open water and neighbouring fields may contain livestock, so please take care when exploring.
Food and Allergens
Pre-ordered meals are bought in from registered food producers and are stored for you until your arrival. Ingredients lists are available for every meal and we are happy to send these to you before you choose. Please tell us about any allergies or dietary requirements when you book. While we will take care in selecting food and drink for you, we cannot guarantee that any item is free from allergens.
Your Stay
Please treat the apartment, grounds and neighbours with respect. You will be responsible for any damage caused during your stay, beyond normal wear and tear.
Smoking, including e-cigarettes, is not permitted in the apartment, the retreat room or our vehicles.
We do not accept pets.
Minimum age: 18 years
We reserve the right to refuse or end the stay of any guest whose behaviour causes damage, distress or offence, or who has symptoms likely to cause ill health to others. In such cases no refund will be given.
Special Requests
Please tell us about any special requests when you book. We will always try to help, but we cannot guarantee that a request can be met, and we cannot accept bookings that depend on a special request being fulfilled.
Our Liability
Some parts of the retreat are provided by independent practitioners and suppliers, who are responsible for their own services. We cannot accept liability for their acts or omissions, although we take care in choosing who we work with.
We are not liable for unforeseeable or indirect losses, or for any loss, cost, damage or claim resulting from:
i. any act or omission by you;
ii. the act or omission of any third party unconnected with the retreat, which was unforeseeable or unavoidable;
iii. unusual or unforeseeable circumstances beyond our control, the consequences of which could not have been avoided even with all due care.
We cannot be responsible for travel arrangements you make yourself, and we cannot accept responsibility for loss of or damage to personal belongings.
Nothing in these terms limits our liability for death or personal injury caused by our negligence.
Insurance
We strongly recommend that you take out travel insurance, including cancellation cover, when you book.
Complaints
We welcome your feedback. If anything is not as it should be during your stay, please tell us straight away so we can put it right. Any complaint should be raised within 28 days of the end of your retreat, as after that our ability to look into it properly may be affected.
Data Protection
We take your privacy seriously and handle your personal information in line with data protection law. We use the details you give us, including any health information or special requirements, only to arrange and run your retreat safely. We may share relevant details with the practitioners providing your sessions where needed. We will never pass your information to anyone who is not involved in your retreat. With your permission, we may keep in touch with you about future retreats.
Full details are set out in our Privacy Policy.
Photographs
We may take photographs during the retreat, for example of the places we visit. We will always ask your permission before taking or using any photograph in which you can be identified.
Force Majeure
Unless stated otherwise in these terms, we will not be liable if we are prevented from fulfilling our obligations by events outwith our control, including (but not limited to) severe weather, natural disasters, fire, flood, road closures, illness of a practitioner, government action, pandemic, industrial disputes, and technical or mechanical breakdown.
Enforceability
If any part of these terms is found to be unlawful or unenforceable, the rest will remain valid.
Governing Law
These terms and conditions are governed by Scots law, and any claim arising from them will be dealt with by the Scottish courts.
